Terms and Conditions (boring)

Article 1 – Definitions

  1. Slaaphuisje Chutzpah: MIMI Creative Content B.V., located in Borger, Chamber of Commerce number 69239657.
  2. Recreational apartment: Holiday accommodation used for recreational purposes.
  3. Main Guest: The person with whom Slaaphuisje Chutzpah has entered into an agreement.
  4. Co-Guest: The person or persons listed on the agreement in addition to the Main Guest.
  5. Guests: The Main Guest and/or any Co-Guests collectively.
  6. Third Parties: Other persons (not Guests).


Article 2 – Applicability

  1. These terms and conditions apply to all quotations, offers, activities, orders, agreements, and deliveries of services or products by or on behalf of Slaaphuisje Chutzpah.
  2. Deviations from these terms and conditions are only valid if agreed in writing by Slaaphuisje Chutzpah and the Main Guest.
  3. Slaaphuisje Chutzpah expressly excludes the applicability of any general terms and conditions of the Guests or any third parties.


Article 3 – Prices

  1. Slaaphuisje Chutzpah uses prices in euros, including VAT and tourist tax, and excluding any additional costs.
  2. Slaaphuisje Chutzpah may change the prices of its services and products on its website and in other publications at any time.
  3. Slaaphuisje Chutzpah and the Main Guest agree on a price based on the rates applicable at that time, subject to obvious errors.
  4. If additional costs arise due to changes in taxes and/or levies directly related to the Recreational Apartment, the Main Guest and/or the Co-Guest, such costs may be passed on to the Guests, even after the agreement has been concluded.


Article 4 – Performance of the Agreement

  1. Slaaphuisje Chutzpah makes the recreational apartment at Eeserstraat 24, 9531 CM Borger available for recreational purposes for the agreed period.
  2. Performance of the agreement takes place in consultation and after written confirmation and payment of any deposit by the Main Guest.
  3. The Main Guest is responsible for informing any Co-Guests and/or Third Parties, if applicable, of these general terms and conditions.
  4. The agreement ends after the agreed period.


Article 5 – Cancellation and Early Termination

  1. If the Main Guest cancels before the start date of the stay, the following amounts are owed to Slaaphuisje Chutzpah:
    - Up to 4 weeks before the start date: 0% of the agreed price excluding tourist tax.
    - Between 4 and 2 weeks before the start date: 30% of the agreed price excluding tourist tax.
    - Between 2 and 1 week before the start date: 70% of the agreed price excluding tourist tax.
    - Within 1 week of the start date: 100% of the agreed price excluding tourist tax.
  2. Slaaphuisje Chutzpah has the right to cancel the booking without stating reasons up to 1 week before the start date. The full price will be refunded without costs.
  3. Slaaphuisje Chutzpah has the right to immediately terminate the agreement without refund in the following cases:
    - Guests fail to follow instructions from Slaaphuisje Chutzpah or persons acting on its behalf, despite multiple warnings.
    - Guests cause nuisance in or near the recreational apartment.
    - Guests commit an alleged criminal offense.
  4. If Guests leave before the agreed end date, no refund will be provided.
  5. Any transaction costs are always payable by the Main Guest.


Article 6 – Use by Third Parties

  1. Third parties are not permitted to use the Recreational Apartment and/or its grounds without the written consent of Slaaphuisje Chutzpah.


Article 7 – Complaints

  1. Complaints from Guests must be handled adequately and with appropriate urgency by Slaaphuisje Chutzpah, with due regard for reasonableness and fairness.


Article 8 – Liability

  1. Slaaphuisje Chutzpah cannot be held liable for damage suffered by Guests and/or Third Parties in the Recreational Apartment and/or on the associated grounds. Guests and/or Third Parties indemnify Slaaphuisje Chutzpah against such liability.
  2. Slaaphuisje Chutzpah is only liable for damage resulting from gross negligence or intent.
  3. Any right of Guests and/or Third Parties to compensation expires 12 months after the event from which the liability arises, directly or indirectly. This does not exclude the provisions of Article 6:89 of the Dutch Civil Code.


Article 9 – Dissolution

  1. The Main Guest may dissolve the agreement when Slaaphuisje Chutzpah attributable fails to meet its obligations, unless the failure does not justify dissolution due to its special nature or minor significance.
  2. If performance by Slaaphuisje Chutzpah is still possible, dissolution may only take place after Slaaphuisje Chutzpah is in default.
  3. Slaaphuisje Chutzpah may dissolve the agreement with the Main Guest if the Main Guest fails to meet their obligations, or if Slaaphuisje Chutzpah becomes aware of circumstances that give good reason to assume that the Main Guest will not fulfil their obligations.


Article 11 – Force Majeure

  1. In addition to Article 6:75 of the Dutch Civil Code, a failure by Slaaphuisje Chutzpah cannot be attributed to it if there is a situation of force majeure.
  2. Force majeure includes, but is not limited to:
    - emergencies such as civil war or natural disasters
    - default or force majeure by suppliers, couriers, or others
    - power, electricity, internet, computer, or telecom failures
    - computer viruses
    - strikes
    - government measures
    - transport problems
    - poor weather conditions
    - work interruptions
  3. If a force majeure situation prevents Slaaphuisje Chutzpah from fulfilling one or more obligations, such obligations are suspended until performance becomes possible.
  4. If a force majeure situation lasts at least 30 calendar days, both the Main Guest and Slaaphuisje Chutzpah may dissolve the agreement in whole or in part by written notice.
  5. Slaaphuisje Chutzpah does not owe any compensation in a force majeure situation, even if it benefits from it.


Article 12 – Amendments to the General Terms and Conditions

  1. Slaaphuisje Chutzpah may amend these general terms and conditions.
  2. Minor amendments may be implemented at any time.
  3. Significant amendments will—where possible—be discussed with the Main Guest in advance.
  4. In the event of a significant amendment, the Main Guest may terminate the underlying agreement.


Article 13 – Transfer of Rights

  1. Guests may not transfer rights under an agreement with Slaaphuisje Chutzpah to others without written consent from Slaaphuisje Chutzpah.
  2. This provision constitutes a clause with proprietary effect as referred to in Article 3:83(2) of the Dutch Civil Code.


Article 14 – Consequences of Nullity or Voidability

  1. If one or more provisions of these general terms and conditions prove null or voidable, this does not affect the validity of the remaining provisions.
  2. A null or voidable provision will be replaced by a provision that most closely reflects what Slaaphuisje Chutzpah intended when drafting the terms.


Article 15 – Applicable Law and Competent Court

  1. These general terms and conditions are governed by Dutch law.
  2. The court in the district of the registered office of Slaaphuisje Chutzpah has exclusive jurisdiction to hear disputes between the Guest and Slaaphuisje Chutzpah, unless mandatory law provides otherwise.
